JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-05-2019 This petition has been listed under the heading "To Be Mentioned" on the basis of mentioning slip filed on behalf of the petitioner on the ground that the marriage of sister of the petitioner is going to be solemnized on 24.05.2019. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 412, 413, 414 of the Indian Penal Code and 25(1-b)a, 26(I)(II)/35 of Arms Act. Learned counsel of the petitioner submits that neither petitioner was caught on the spot nor anything was recovered from his conscious possession and the name of petitioner came in this case in confessional statement of co-accused Shaurabh

Para 3 of the petition goes to show that the petitioner has criminal antecedent of three cases but submission on behalf of the petitioner is that when petitioner was remanded in the present case, police implicated the petitioner in other three cases which have been mentioned at para 3 of the petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Begusarai in connection with Birpur P. S. Case No. 134 of 2018.
