ABHISHEK REDDY ORAL ORDER 18-09-2023 Learned counsel for the petitioner has stated that as per the requirement of the Respondent's corporation, the No Objection Certificate (NOC) has to be issued by the District Magistrate i.e. Respondent No. 2 herein. Learned counsel states that even though a report has been submitted by the Respondent No. 4 vide Letter No. 781 dated 24.04.2023 (Annexure No. 5) recommending for issuance of NOC, the respondent No. 2 is yet to grant the NOC. Learned counsel seeks a direction from the Hon'ble Court to direct the Respondent No. 2 to issue the

Patna High Court CWJC No.7864 of 2023(2) dt.18-09-2023 2/2 N.O.C. duly taking into account the report submitted by Respondent No. 4.

Learned counsel for the respondents has stated that he has no objection if a direction is given to Respondent No. 2 to consider the report of the Respondent No. 4 and pass necessary orders in accordance with law.

Without going into the merits or demerits of the case, having regard to the fact that the matter is pending before the Respondent No. 2 for issuance of the N.O.C., the Respondent No. 2 is directed to pass necessary orders duly taking into account the report submitted by the Executive Engineer, Rural Works Department, Work Division, Maharajganj, DistrictSiwan (Respondent No. 4) as expeditiously as possible preferably within a period of four weeks from the date of receipt of the copy of this order.

With the above made submissions, the writ petition is disposed of .
