The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R., this petitioner alongwith co-accused Sarita Devi, Sapna Devi, Punam Devi and Lalita Devi assaulted with bricks and broke the door of informant.

It is submitted on behalf of petitioner that specific allegation of assault is against co-accused Amar Kumar, Dharmendra Kumar and Binod Singh. So far as petitioner is concerned, there is general and omnibus allegation. Petitioner is gotiya of informant. There is land dispute between the parties and a proceeding under Section 144 Cr.P.C. is going on. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.32588 of 2022(2) dt.10-10-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Khagaria Muffasil P.S. Case No. 104 of 2022, arising out of G.R. No. 311 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
