In this case, the petitioners are seeking regular bail in connection with Belhar P.S. Case No. 220 of 2020, registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act.

It has been alleged that 72 litres of liquor kept in a plastic bag, has been recovered from the motor cycle of the petitioners Learned counsel for the petitioners submits that the petitioners are in custody since 27.06.2020, having clean antecedent.

No.31119 of 2020(2) dt.29-01-2021 2/2 Looking to the period of custody, quantity of liquor and clean antecedent of the petitioners, let the petitioners above named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Banka in connection with Belhar P.S. Case No. 220 of 2020, subject to the condition that one of the bailors of the petitioners shall be their close relative. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court. If the petitioners are found involved in the similar type of offence in future, the prosecution will have liberty to make prayer for cancellation of their bail before the court below and the court below will take decision in accordance with law.
