The petitioner seeks bail in Chautham P.S. Case No. 39 of 2021, registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R., three unknown miscreants, riding on a motorcycle, intercepted the vehicle of husband of informant and by introducing themselves to be government servant, demanded documents of his vehicle and when the husband of informant tried to show document to them, one of them fired at him, as a result of which, the husband of informant sustained fire-arm injury.

It is submitted on behalf of petitioner that name of the petitioner has come during course of investigation. Only

Patna High Court CR. MISC. No.41516 of 2021(2) dt.16-12-2021 2/2 material, which has come against the petitioner, is that the victim identified this petitioner through viral video. Petitioner has got clean antecedent and he is in custody since 07.03.2021. Chargesheet has been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Considering the period of custody of petitioner, his bail petition is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Khagaria in connection with Chautham P.S.
