Heard learned counsels for the parties.

The present writ application has been preferred for quashing the order issued vide Memo No. 1733(A) dated 10.10.2015 by the Superintendent of Police, Bagha, as contained in Annexure 1, whereby the petitioner has been put under suspension with effect from 8.10.2015 and departmental proceeding was initiated against the petitioner. Mr. Sharma, learned counsel appearing on behalf of the respondents State submits that the department

Patna High Court CWJC No.8099 of 2016(4) dt.18-06-2020 2/2 proceeding initiated against the petitioner has been concluded and the petitioner has been dismissed from service. The order of dismissal has also been challenged in appeal. Hence, this writ application has become infructuous.

Learned counsel for the petitioner seeks permission to withdraw this writ application with a liberty to the petitioner to challenge the order of punishment before the appropriate authority in accordance with law.

This writ application is, accordingly disposed of as withdrawn with the liberty aforementioned.
