The petitioner is languishing in custody for the offence punishable under Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act, 2016.
Recovery of liquor is alleged from the river side. It is alleged that the same was of the petitioner. Petitioner has got several cases of identical nature. He is in custody since 18.03.2019.
Considering the entire facts, let the petitioner, above named, be released on bail if the trial is not concluded within six months from the date of submission of chargesheet against the petitioner on furnishing bail bond of
Patna High Court CR. MISC. No.31303 of 2019(2) dt.10-05-2019 2/2 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Tharthari P.S. Case No. 15 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Banti/Rajan U T
