The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 332, 333, 307 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case, in short, is that a mob variously armed suddenly started attacking on unknown persons due to which they sustained injuries.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioners have falsely been implicated in the present case. After investigation, the police submitted final form finding the case to be false against the petitioner. The Court has
Patna High Court Cr.Misc. No.67463 of 2018(2) dt.22-11-2018 2/2 differed with the police report and taken cognizance in the present case. Other co-accuseds have been granted anticipatory bail vide Annexure-4 to the present application. On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Daudnagar in connection with Daudnagar P.S. Case No. 135/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
