JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Baghaila P.S. Case No. 89 of 2018 registered for the offences punishable under Sections 30(a)(c) (d) (g), 32(i), 34(a) (b) and 36 of Bihar Prohibition and Excise Act. Prosecution story is that police on information of manufacturing of liquor near the bank of Kav river raided the place and accused persons succeeded in fleeing away and police recovered 20 litres of liquor and other articles for manufacturing liquor and petitioner is named in the FIR and apart from that petitioner is accused in seven other cases.
Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and in all seven cases he is on bail.
Heard learned APP also.
Patna High Court CR. MISC. No.34963 of 2019(3) dt.22-08-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit.
With the above observation, this application is dismissed.
