1. Heard learned counsel for the petitioner and learned A.P.P. for the State Mr. Chandra Bhushan Prasad.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 111(2) of BNS and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and allegation is of recovery of 750 litres of liquor from a bush and a motorcycle was seized. It is next submitted that petitioner is not the owner of the seized vehicle and even the alleged recovery is from a place which does not belong to the petitioner but since petitioner resides nearby the place of occurrence, as such he was arrested and is in custody since 02.03.2026.

4. Learned A.P.P. opposes the prayer for bail of the

Patna High Court CR. MISC. No.31518 of 2026(2) dt.15-05-2026 2/2 petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.5000/- (Rupees five thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kawakol P.S. Case No.120/2026.
