2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 74, 303(2), 352, 351(2) and 3(5) of the B.N.S.
3. The case of the prosecution, in short, is that the petitioner has pushed the informant due to which she fell down. It is further alleged that he also pulled her saree. It is further alleged that the petitioner has pulled the husband of the informant by covering his neck with his stole.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel of the petitioner has submitted that from
Patna High Court CR. MISC. No.31784 of 2026(2) dt.13-05-2026 2/2 perusal of the FIR, it is clear that allegation of assaulting with knife is on Bhola Kumar. It has further been submitted that from perusal of the injury report of Baiju Ray, the husband of the informant, it will transpire that he has received a lacerated wound which is grievous in nature. No other wound on neck and no injury of Shiv Shankar Ray is there. Petitioner is aged about 51 years. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 09.02.2026.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 43 of 2026.
