The petitioner is languishing in custody for the offences punishable under Sections 30(a)/38/41 of the Bihar Prohibition and Excise Act.

Recovery of huge quantity liquor is alleged from the referred truck. Owner and driver of the said truck who were not there are accused in this case.

Learned counsel for the petitioner submits that petitioner is neither owner nor driver of the said truck. The petitioner is in custody since 12.06.2020. Investigation of the case is already complete.

Petitioner has got criminal antecedent for the offences

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kanti P.S. Case No.696 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) With condition that if the petitioner would be found involved in subsequent similar act that would be a ground for cancellation of bail in this case also by the Courtbelow itself. (Birendra Kumar, J) Mkr./- U T
