JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-03-2022 Heard learned counsel for the petitioners and the State. The petitioners pray for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code. As per the prosecution case, FIR named accused persons including the petitioners are suspected to have killed informant's son. It is alleged that in past accused persons had threatened the informant's of dire consequences. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case on the basis of suspicion. Informant is not the eye witness of the occurrence. No substantive evidence has been collected

Patna High Court CR. MISC. No.41837 of 2021(3) dt.10-03-2022 2/2 during course of investigation to suggest the implication of this petitioners in the present case. Petitioners are in custody since 22.3.2021.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let both the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XV, Vaishali at Hajipur in Kartahan Police Station Case No. 3 of 2021.
