The petitioners seek bail in anticipation of their arrest in connection with Bagaha P.S. Case No. 179 of 2017 dated 12.04.2017 instituted for the offences under Sections 147, 148, 149, 323, 324, 325, 307, 379, 504 and 34 of the Indian Penal Code.
Around 22 persons have been made accused in this case with the allegation that all of them assaulted the members of the prosecution party with hard and blunt substance as well as sharp cutting weapons. Seven persons are said to have received injuries.
Learned counsel appearing for the petitioners has submitted that out of the accused persons named in
Patna High Court Cr.Misc. No.64000 of 2018(2) dt.13-12-2018 2/2 the FIR, 13 accused persons have been granted anticipatory bail by different benches of this Court. Learned counsel for the petitioners has also drawn the attention of this Court to the counter case which is Annexure-2 to this petition.
Considering the aforesaid facts, the petitioners above named are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Bagaha, West Champaran in connection with Bagaha P.S. Case No. 179 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
