JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Amarpur P.S. Case No. 76 of 2012, G.R.No. 536 of 2012, registered for the offences punishable under Sections 147, 148, 149, 341 and 302 of the Indian Penal Code. Altogether 15 persons, including the petitioner are named in the FIR and there is allegation of causing death of the deceased.

Submission of learned counsel for the petitioner is that no specific allegation has been attributed against him and as investigation is continuing against the petitioner he has not surrendered earlier. Other accused persons have been granted anticipatory bail by the then co-ordinate Bench of this Court by order dated 9.10.2013 passed in Cr.Misc.No. 31397 of 2013. Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.45092 of 2019(3) dt.21-10-2019 2/2 anticipatory bail on the ground that after seven years petitioner has come for grant of anticipatory bail, during that period he was evading arrest.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender in the court below within a period of three weeks from the receipt of this order and pray for regular bail, which shall be considered on the basis of submission made above as well as the fact that other co-accused persons have been granted privilege of anticipatory bail and disposed of, if possible, on the same day.
