None ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-01-2021 Heard learned counsel for the petitioner. No one appears on behalf of the State, although the name of Advocate General appears in the cause list.

The petitioner is in custody in connection with Rasulpur P.S. Case No. 112 of 2019 (S.Tr. No. 200 of 2020) for the offence under Sections 395 and 397 of the Indian Penal Code.

Learned counsel for the petitioner submits that the case was registered against unknown. As per prosecution case Rs. 10,000/- cash and mobile phone was looted. The petitioner was remanded in this case on 04.12.2019.

Considering the fact that the F.I.R. was lodged against unknown and also the fact that the petitioner is in custody since 04.12.2019, the petitioner, named above, is directed to be

Patna High Court CR. MISC. No.30953 of 2020(2) dt.06-01-2021 2/2 released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-X, Saran at Chapra in connection with Rasulpur P.S. Case No. 112 of 2019 (S.Tr. No. 200 of 2020) subject to the condition that the petitioner shall deposit Rs.10,000/- (Ten thousand) cash in the court below and the same shall abide by the final outcome in the trial i.e. if the petitioner is acquitted the amount of Rs.10,000/- shall be refunded in favour of the petitioner, otherwise it shall be forfeited.
