JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 414 of the Indian Penal Code.

Co-accused Raju Kumar was apprehended with stolen motorcycle who disclosed that he purchased the motorcycle from this petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery of the motorcycle. Petitioner has got no criminal antecedent.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Saran at Chapra in Khaira Police Station Case No. 38 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
