JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Mirganj P.S. Case No. 321 of 2016 dated 03.11.2016 instituted for the offences under Sections 467, 468, 471, 420, 120(B), 384, 34 of the Indian Penal Code.

The petitioner has been successful in obtaining the post of Panchayat Teacher. He is alleged to be in company of co-accused Yogendra Ram, Panchayat Secretary. The present case has been lodged by the

Patna High Court Cr.Misc. No.66587 of 2018(2) dt.17-12-2018 2/3 informant who has not been successful in getting appointed as Panchayat Teacher. He has stated that during the course of hearing of the Appeal against the appointment of the petitioner before the Tribunal, he was demanded money for the purposes of the same being distributed amongest others.

The learned counsel for the petitioner has submitted that neither any demand has been put up by the petitioner nor is there any allegation against the petitioner of influencing the process of appointment.

Considering the vague nature of allegation against the petitioner and that also at the instance of a person who was not successful in getting appointed as a Panchayat Teacher, whereas petitioner has, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XVI, Gopalganj in connection
