2. The accused/petitioner is named in the FIR and is apprehending his arrest in connection with Piprakothi P.S. Case No.247 of 2025, registered under Sections 303(2), 317(5), 325, 112 read with 3(5) of the Bhartiya Nyaya Sanhita, 2023 (in short 'B.N.S.') as well as Sections 11, 11(1)(c), 11(1)(d), 11(1)(f), 11(1)(g) and 11(1)(e) of the Animal Cruelty Act.
3. As per FIR, the petitioner and other co-accused persons allegedly are involved in theft of buffaloes of adjacent villages and thereafter to sell the stolen buffaloes in Nepal for higher price.
4. It is submitted by learned counsel appearing for petitioner that the petitioner was not apprehended at the spot and his name was disclosed by the apprehended co-accused person.

It is submitted that the investigation of this case into all material aspects has already been completed, therefore, sending this petitioner behind the bar would not serve any purpose. The petitioner has got no antecedent. It is lastly submitted that similarly situated co-accused, namely, Shekh Nihal @ Md. Rehan has been allowed the privilege of anticipatory bail by a Coordinate Bench of this Court by order dated 27.04.2026 passed in Cr. Misc. No. 26707 of 2026.
5. Learned APP opposed the prayer for anticipatory bail of the petitioner.
6. Heard the parties and perused the record.
Considering the facts and circumstances and parity, let the petitioner, above-named, in the event of his arrest or surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 21st District & Additional Sessions Judge, East Champaran, Motihari, in connection with Piprakothi P.S. Case No.247 of 2025, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik
