The prayer for bail of the petitioner was earlier rejected vide order dated 20.08.2020 passed in Cr. Misc. No. 21570 of 2020.

This Court had called for a report from the court below about the stage of the case. It appears that no witness has been examined up till now.

The petitioner is in custody since 13.02.2020. Since he is alleged to have assaulted the deceased by means of a lathi on his head, I am not inclined to grant bail to him for the present. The prayer for bail is rejected.

However, looking at the period of custody, it is

Patna High Court CR. MISC. No.41580 of 2021(3) dt.24-11-2021 2/2 directed that the trial court shall take all possible steps to conclude the trial within a period of nine months. Should there being no substantial progress in the trial within the next six months, it would be open for the petitioner to approach the trial court and in that event the court below shall be under an obligation to indicate the reasons for the tardy progress of the trial.
