In this case, the petitioner is seeking regular bail in connection with Kalyanpur P.S. Case No. 303 of 2022, registered for the offences punishable under Sections 341, 302, 504/34 of the I.P.C. and Section 27 of the Arms Act. As per allegation, six named accused persons including the petitioner made hindrance in Panchayti. At the order of co-accused Rajesh Sah, co-accused Sonu Kumar Sah and Manish Kumar Sah opened indiscriminate firing, resulting into death of the father of the informant. One Sunil Paswan was also injured.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.32912 of 2023(2) dt.21-06-2023 2/2 that the allegation against the petitioner is general and omnibus. There is no overt act against him. He is a person of clean antecedent and is under custody since 20.02.2023. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Samastipur in connection with Kalyanpur P.S. Case No. 303 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
