JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 21-06-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Udakishunganj P.S. Case No. 361 of 2022, registered for offence punishable under Sections 341, 323, 420, 386, 504, 506/34 of the Indian Penal Code.

The informant claims himself to be mentally ill person. He is brother-in-law (Shala) of the petitioner. As per allegation, the petitioner brought him in Registry office and got sale deed executed by the informant in his favour and also threatened him to kill had he narrated his incident to anyone. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

As a matter of fact, in view of the advance given by the petitioner for treatment of the informant, the sale deed was executed by him. The learned counsel has also submitted that it is purely a civil matter.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Udakishunganj, District-Madhepura in connection with Udakishunganj P.S. Case No. 361 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
