Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Jankinagar P.S. Case No. 217 of 2022 registered for the offence under Section 366, 364, 370-A and 370 of the Indian Penal Code.
The accused/petitioner is named in the F.I.R. and is in custody since 21.01.2023.
The allegation against this petitioner is to kidnap the
Patna High Court CR. MISC. No.33069 of 2023(2) dt.22-06-2023 2/3 brother of informant along with his wife and minor children and also found involved in human trafficking.
Learned counsel appearing on behalf of the petitioner submitted that the thrust of allegation is available against the main co-accused, namely, Pankaj Kumar, who happens to be son of petitioner. It is submitted that implication of present petitioner is only being father of the main co-accused. While concluding the argument, it has been submitted that petitioner is a man of clean antecedent and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence. Learned APP opposed the prayer of bail.
Considering the facts and circumstances as mentioned above, as the thrust of allegation is available against co-accused Pankaj Kumar, where implication of this petitioner appears only being father of main co-accused, coupled with the fact that charge-sheet has been submitted, where petitioner is in custody since 21.01.2023, accordingly the petitioner, above named, is directed to be released on bail in connection with Jankinagar P.S. Case No. 217 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
