JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bhagwanpur P.S. Case No. 214 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Prosecution story is that informant got an information that his cousin sister has died and on that information he reached at her house and found her dead body lying there and he suspected that some unknown criminals have committed murder to her. It further appears from the impugned order that during investigation mother-in-law of deceased has disclosed the name of the petitioner and daughter of deceased disclosed the name of co-accused that he was along with another person. Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner on the ground that mother-inlaw of deceased has named this petitioner. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, dismissed.
