The petitioner seeks bail in anticipation of his arrest in connection with Mashrak P. S. Case No. 327 of 2017 instituted for the offences under Sections 406, 419, 420, 467, 468, 471, 120B and 34 of the Indian Penal Code. The petitioner is alleged to be one of the Directors of a Chit Fund Company where more than 50 crores of money has been invested by people. It has further been alleged by the informant that after the investments were made, the company has been closed and the functionaries of the company, namely, Indus Ware Industries Limited, have

Learned advocate appearing for the petitioner has submitted that though the petitioner has been shown as a Director but the fact of the matter is that he was also only an investor in the company. In support of aforesaid contention, learned counsel for the petitioner has drawn the attention of this Court to the fact that in the complaints lodged against the company, the petitioner is a witness. The aforesaid complaint cases are numbered as Complaint Case Nos. 917 of 2017 and 437 of 2018.

Two of the officials of the aforesaid company, namely, the Branch Manager as well as one of the Directors have been granted anticipatory bail.

Considering the aforesaid facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-

However, it is made clear that the petitioner ought to participate in the investigation and should cooperate with the investigating agency fully. In case it is found that he has run away from the process of investigation, it will be open for the investigation agency to proceed ahead for seeking cancellation of his anticipatory bail.
