The petitioner has challenged the order dated 28.08.2020 issued under the signature of respondent no. 3, whereby he has been transferred from the post of Assistant
Patna High Court CWJC No.8207 of 2020(2) dt.06-10-2020 2/3 Agriculture Officer, Bettiah to the office of the District Agriculture Officer in a different block at Nauhatta in the district of Saharsa.
The challenge is basically on the ground of ill health of his wife, which was earlier taken into account when his transfer was stalled.
According to the pleadings in this case, the petitioner has already joined his transferred place of posting. In that view of the matter, this Court would not interfere with the order of the transfer.
However, considering the ill health of the wife of the petitioner, the petitioner at least is given he liberty to approach the Joint Secretary, Department of Agriculture, Govt. of Bihar, Patna (respondent no. 3) and explain to him the circumstances under which his claim for his repatriation to old place of posting be considered.
Such an application shall be filed by the petitioner within a period of four weeks from today and a reasonable order shall be passed by respondent no. 3 on the aforesaid application within a further period of four weeks thereafter.
