Petitioner seeks bail in Dumariya Ghat P.S. Case No.87 of 2018 instituted for the offence under Section(s) 392 Indian Penal Code.

Counsel for the petitioner submits that Petitioner is in custody since 18.12.2018 without having any specific allegation of overt act against him. First Information Report is against unknown. During course of investigation, police arrested the petitioner on the basis of location of mobile tower and seizure of one mobile phone from possession of the petitioner. Counsel for the petitioner further submits that no TIP has ever been held either of the petitioner or of the aforesaid mobile.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, in connection with Dumariya Ghat P.S. Case No.87 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
