2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 74, 109, 303 , 191 ( 2 ), 191 (3) ,329 ( 4 ), 126 ( 2 ), 324 (5) , 115 , 117(2) of BNS. 3 . As per the prosecution case , on the alleged date and time of occurrence , all the F.I.R., named accused persons including this petitioner armed with lathi, danda assaulted informant and his family members.

4. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence as alleged. Both parties are co-villagers and due to dispute over digging soak pit, a simple occurrence of maarpeet took place between other co-accused persons and informant side . Allegation of

Patna High Court CR. MISC. No.30900 of 2025(3) dt.25-07-2025 2/2 assault is general and omnibus. No specific overt act has been alleged against this petitioner. Petitioner claims clean antecedent. Similarly situated co-accused person has already granted bail by this Court vide order dated 05.05.2025 in Cr. Misc. No. 24923 of 2025 .

5 . Learned counsel for the State opposed the bail petition .

6 Considering the general and omnibus allegation of assault against this petitioner, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class (West ) Muzzaffarpur in connection with Karza P.S. Case No. 254 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
