Mr. APP ============================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-12-2020 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in connection with C2231/20 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears from the First Information Report that approximately 180 litres of liquor was recovered from the petitioners.

It has been claimed by the petitioners that they have been wrongly made accused in this case at the instance

Patna High Court CR. MISC. No.31348 of 2020(2) dt.02-12-2020 2/2 of the S.S.B. personnel. In fact, the petitioners have been named because of suspicion as they were coming from the side of Nepal into India.

The petitioners do not have criminal antecedents and are in custody since 12.06.2020.

Regard being had to the afore-stated facts, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge -II-cum-Special Judge (Excise), Sitamarhi, in connection with C2-231/20 .
