The petitioners who are father and sons respectively have sought bail in anticipation of their arrest in connection with Teghra P.S. Case No. 263 of 2018 dated 14.07.2018 instituted for the offences under Sections 447, 341, 307, 379, 504, 354, 506 and 34 of the Indian Penal Code.
The petitioners are alleged to have created disturbance in the peaceful possession of the land of the informant. Petitioner no. 2 is alleged to have fired which did not hit anybody.
Learned counsel appearing for the petitioner has submitted that the falsity of the case would appear
Patna High Court Cr.Misc. No.64017 of 2018(2) dt.13-12-2018 2/2 from the fact that after ten days of the occurrence, the FIR has been lodged and that nobody has received any injury in the occurrence. The petitioners actually are the real claimants of the land in question.
Considering the aforesaid facts as also taking into account that the petitioners do not have any criminal antecedents, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No. 263 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
