====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-07-2023 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 353 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, a free fight took place in between two groups and when the police party tried to pacify the quarrel, both groups entangled with the police party. Thereafter, indiscriminate firing was made with illegitimate weapons to create panic.
4. It is submitted that allegation against the petitioner is general and omnibus. Though there is allegation of indiscriminate firing but no one sustained any fire arms injury. Moreover, similarly situated co-accused persons have already been granted bail by co-ordinate Benches of this Hon'ble Court
Patna High Court CR. MISC. No.34563 of 2023(2) dt.27-07-2023 2/2 vide orders dated 28.03.2023 and 25.05.2023 passed in Cr. Misc. Nos. 2576 of 2023 and 17511 of 2023 simultaneously.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Nalanda at Biharsharif in connection with Manpur P. S. Case No. 191 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
