JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-05-2019 The petitioner has challenged the order dated 15.04.2014 passed by the learned Chief Judicial Magistrate, Kaimur at Bhabua whereby he has transferred Kudara P.S. Case No. 190 of 2013 to another learned Judicial Magistrate for disposal of the case.

The challenge is basically on the ground that without taking cognizance, the case has been transferred.

This Court is not inclined to interfere with the aforesaid order at this stage. However, if the petitioner so desires and is advised accordingly, he may prefer an

Patna High Court CR. MISC. No.16854 of 2015(3) dt.16-05-2019 2/2 application for discharge before the Court below, if such an application has not already been filed and disposed off. In the event of the trial in the case having commenced, this Court can only direct the Trial Court to conclude the same as early as possible.

With the aforesaid observation, the petition is dismissed.
