The petitioners are apprehending their arrest in connection with Mashrakh P.S. Case No. 19 of 2018 for the offence under Sections 379/411 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that the instant case has been registered at the instance of Kirani Kumar Sub-Inspector of Police, Mashrakh. Learned counsel for the petitioner submits that the petitioners names surfaced on the confessional statement of the co-accused who was arrested at the spot. Learned counsel for the petitioner submits that the petitioners have no criminal antecedents nothing was found from the conscious possession of the
Patna High Court Cr.Misc. No.68329 of 2018(2) dt.17-12-2018 2/2 petitioner. The Tractor and Motorcycle were seized from the person who was arrested at the spot.
Considering the facts that petitioners have no criminal antecedent and the stolen tractor and motorcycle were seized from the possession of the co-accused and submissions that petitioners have no concern with the motorcycle and tractor, let the petitioners above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Court of learned Additional Chief Judicial Magistrate-6th, Chapra in connection with Mashrakh P.S.
