====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-01-2021 Heard learned counsel for the petitioner. No one appears on behalf of the State although the name of the Advocate General is appearing in the cause list. Petitioner is in custody in connection with Sahebganj P.S. Case No. 359 of 2020 for the offence under sections 272, 273, 120(B), 414 of the Indian Penal Code and Section 25(1b)a and 26 of the Arms Act and Section 30(a)(g), 33, 34(B), 35(A), 36, 41(a)(ii) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that in the instant case total 599 liters of Indian Made Foreign Liquors was seized from different place.

The petitioner is in custody since 7.7.2020.

Considering the fact that recovery was made from the different place and not from the exclusive possession of the

Patna High Court CR. MISC. No.31010 of 2020(2) dt.08-01-2021 2/2 petitioner, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge,Excise Act, Muzaffarpur, in connection with Sahebganj P.S. Case No. 359 of 2020 subject to the condition that the petitioner shall deposit Rs. 50000/- cash to the court below and the amount of Rs. 50000/- deposited by the petitioner shall abide by final outcome of Sahebganj P.S. Case No. 359 of 2020.
