JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 420, 406, 504/34 of the Indian Penal Code.

The complainant claims that petitioners took huge amount from her in the name of opening of schools but subsequently, when she demanded her money back, the petitioners refused to make payment.

Submission on behalf of the petitioners is that petitioner no. 1 was President whereas complainant was Secretary in Nijamia Muslim Charitable Trust and as a matter of fact, lands were purchased for the aforesaid trust and not only

However, the lands were purchased in the name of complainant, petitioners and several other persons which is evident from perusal of Annexure-2 to this petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Kishanganj Complaint Case No. 1337 of 2015 subject to condition as laid down under Section 438(2) of the Cr.P.C.
