JUSTICE ANIL KUMAR SINHA ORAL ORDER 01-02-2022 Heard Mr. Kundan Kumar Singh, learned counsel for the petitioner and Mr. Akshay Lal Pandit, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Araria PS Case No. 342/2021 registered for the offence punishable under Sections 25(1), (1A), (1AA), 26 (3) of the Arms Act. One country made pistol without cartridge has been recovered from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case at the instance of one Md. Shamshad with whom there was dispute with regard to payment of Rs. 5000/- given by the petitioner to him. He further submits that petitioner has got no criminal antecedent and he is in custody since 21.04.2021. Charge-sheet has been submitted in the matter and there is no likelihood that petitioner

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner has got no criminal antecedent and he is in custody since 21.04.2021, charge-sheet has been submitted in the matter and there is no likelihood that petitioner will abscond or will tamper with the evidences if he is released on bail and trial is not likely to be concluded in near future due to pandemic, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, MD. AYAZ ALAM @ AYAZ ALAM be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria PS Case No. 342/2021, GR No. 1237/2021.
