The petitioner through its Principal-cumSecretary has approached this Court seeking a direction upon the respondents, especially the respondent nos. 2 to 4 to grant aid to the Bhagwat Uchch Madhyamid Vidyalaya, Budh Nagar, Bamhaur, Mohania, Kaimur since sessions 2013-2015 till up-todate, in accordance with law.

3. Learned Advocate for the petitioner submitted that the school in question was registered under the Society and

Patna High Court CWJC No.7577 of 2026 dt.28-07-2026 2/3 Trust Act and subsequently the Governing Body of the school appointed the Principal of the school. The school further applied for its affiliation with the Bihar School Examination Board and accordingly the affiliation was also granted with effect from Sessions 2014-2016. After affiliation, list of teaching and non teaching staff of the school was also furnished to the Board. Notwithstanding the aforesaid fact as also in view of resolution No. 538 dated 19.05.2009 taking a concious decision to grant aid to the non-government affiliated school, till date the petitioner's school has not been extended any aid. For redressal of the grievance, the petitioner has filed a detailed representation before the Secretary, Bihar School Examination Board as well as the Director of the concerned Board but no action has been taken.

Considering the nature of the grievance as also in view of the fact that the petitioner has already approached the concerned authorities, this Court deems it fit and proper to dispose off the writ petition with a direction to the Secretary of the Board to take up the representation of the petitioner, copy of which is marked as Annexure-P/2 series and bring to its logical conclusion by passing a reasoned and speaking order.

5. Suffice it to observe that in case the claim of the

Patna High Court CWJC No.7577 of 2026 dt.28-07-2026 3/3 petitioner finds favour, necessary consequential order must be passed, preferably within a period of eight weeks from the date of receipt/production of a copy of this order.

6. With the aforesaid direction, the writ petition stands disposed.
