The petitioner is apprehending his arrest in connection with Nalanda P.S. Case No. 87 of 2017 for the offence under Sections 399, 402, 120 (B) Indian Penal Code and 25 (1-b) A, 26, 35 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent. Allegation against the petitioner as per the disclosure made by the co-accused is that he was also involved in preparation for committing crime. Learned counsel for the petitioner submits that similarly circumstanced other co-accused namely Bed Prakash Yadav @ Bedu have been granted bail by Co-ordinate
Patna High Court Cr.Misc. No.65497 of 2018(2) dt.13-12-2018 2/2 Bench of this Court in Crl misc. No. 61703 of 2018 vide order dated 08.10.2018.
Considering the aforesaid fact that co-accused namely Bed Prakash Yadav @ Bedu have been granted bail by Coordinate Bench of this Court in Crl misc. No. 61703 of 2018 vide order dated 08.10.2018, let the petitioner above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Court of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Nalanda P.S. Case No. 87 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C.
