The petitioner apprehends his arrest in Dhangai P.S. Case No. 32 of 2019, registered for the offences punishable under Sections 354(D), 341, 323, 379, 506, 509 and 34 of the Indian Penal Code and sections 67, 67A of the Information Technology Act.

As per the FIR, this petitioner is alleged to have misbehaved with the informant while she was coming from tuition and also threatened her.

It is submitted that petitioner has been falsely implicated in this case due to village politics. Petitioner is son of co-accused Munni Devi. The mobile which was used for taking photograph of informant on WhatsApp and making viral on

Patna High Court CR. MISC. No.31548 of 2020(2) dt.22-01-2021 2/2 social media does not belong to this petitioner and the same belongs to co-accused Kamlesh Kumar Yadav. Petitioner has got clean antecedent, as stated in para 3 of the petition. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Dhangai P.S. Case No. 32 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
