2. The petitioner seeks regular bail in connection with Ara Town P.S. Case No. 1002/2023 lodged on 11.12.2023 under Sections 307, 326/34 of the Indian Penal Code and 27 of the Arms Act.

3. As per the prosecution case, F.I.R. has been lodged against three accused persons including the present petitioner with an allegation that they have fired on the son of the informant due to which his thigh got injured.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the name of the petitioner has been figured in

Patna High Court CR. MISC. No.37942 of 2024(4) dt.28-08-2024 2/2 this case only due to conspiracy. Counsel further submits that the criminal antecedent of the petitioner is clean and he is in custody since 20.01.2024.

5. Learned APP for the State opposes the prayer for bail and submits that there is direct allegation of firing against the petitioner on the thigh of the informant's son.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named by granted bail three months after framing of charge, if the charge is not framed yet and on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. Case No. 1002/2023 subject to the condition laid down under Section 437(3) of the Cr.P.C.
