Mr. Anirudh Kumar Verma, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 04-10-2018 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 308, 506/34, 302 and 307 of the Indian Penal Code. There is case and counter case. Specific allegation of commission of murderous assault is against co-accused, Guddu. Due to assault of Guddu the informant died during course of treatment.

Learned counsel for the informant opposed the prayer for anticipatory bail.

Considering the fact that no overt act is alleged

Patna High Court Cr.Misc. No.61101 of 2018(2) dt.04-10-2018 2/2 against the petitioners and petitioners have stated on oath that they have got no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Mufassil Police Station Case No.131 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
