Petitioner apprehends his arrest in connection with Araria P.S. Case No. 859 of 2017 registered for the offence punishable under Sections 341, 323, 353, 504 and 506 of the Indian Penal Code.
Petitioner is said to have assaulted the informant, who happens to be guard at the residence of S.P. Araria on his protest against parking of the vehicle by the petitioner on the gate of residence of S.P. and tried to snatch his arms. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner has been falsely implicated in this case. As a matter of fact, the

No.32060 of 2019(2) dt.15-05-2019 2/2 petitioner was assaulted by the informant over row of parking of vehicle and in order to save his skin, the informant has lodged this false and frivolous case against the petitioner. The injury sustained by the informant is simple in nature. Petitioner has no criminal antecedent.
On the other hand, learned APP opposed the bail prayer of the petitioner.
In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Araria in connection with Araria P.S. Case No. 859 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Prakash Chandra Jaiswal, J) rohit/- U T
