Mr. Hitesh Suman, AC to SC 13 ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-03-2025 Heard Mr. Bipin Bihari Singh, learned counsel appearing on behalf of the petitioners and Mr. Hitesh Suman, learned AC to SC 13 for the State.

Petitioners have inter alia prayed for following reliefs in the paragraphs No.1 of the writ petition:- "That, the present writ petition is for issuance of an appropriate writ/writs, order/orders, direction/directions to respondent authorities for acceptance of joining, permission for executing the works and payment of remuneration attached to post in terms of the letter of engagement issued by Panchayat Secretary-cum-Secretary, Panchayat Employment Committee, Bela under Ramgarhwa Block in compliance of the order passed by the District Appellate Authority, East Champaran at Motihari in Appeal Case No.1081/2018 on 13.02.2019 and the further prayer is payment of interest upon due entitlement and litigating for unnecessary harassments and for the other necessary relief/reliefs on the basis of the facts and circumstances of the case as stated hereinafter."

3. Learned counsel appearing on behalf of the petitioners seeks that this case should be considered in light of order dated 13.02.2025 passed in CWJC No.22821 of 2019.

4. It has been informed by learned State Counsel that the case of the petitioners is under consideration of the District Programme Officer (Establishment), East Champaran at

Patna High Court CWJC No.13490 of 2021(4) dt.24-03-2025 3/3 Motihari and to said effect, a statement has been made in paragraph no.10 of the counter affidavit that the order passed by the district Appellate Authority dated 13.02.2019 passed in Appeal No.1081 of 2018 has not been complied.

In view of the above information contained in paragraph no.10 of the counter affidavit in case order dated 13.02.2019 has not been complied till date, the District Programme Officer (Establishment), East Champaran at Motihari must ensure to comply with the order passed by the District Appellate Authority and also ensure payment along with the arrears from the date the petitioners are required to be paid. In case of failure, appropriate action is required to be taken against all the concerned for delaying the matter. It has been informed that no appeal is pending before the State Appellate Authority against the order dated 13.02.2019.
