2. The petitioner seeks bail in connection with Chakia P.S. Case No. 73 of 2024 dated 22.10.2024 instituted for the offence punishable under Sections 103(1), 238, 3(5) of Bhartiya Nyaya Sanhita.

3. The prosecution case, in short, is that on the alleged date of occurrence, the son of the informant along with the petitioner went to coaching centre to teach. It is further alleged that thereafter his son went to the house of petitioner where they took meal and thereafter he was found traceless. Thereafter, his dead body without his head and leg was found in a ditch. His head and leg were found in a ditch of another place. It is alleged that the petitioner and other accused persons have killed his son.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner submits that the occurrence took place on 19.10.2024 and the next day, dead body was recovered. F.I.R. has been lodged on 22.10.2024. As per the information given in First Information Report, the petitioner was arrested on 20.10.2024 and his confessional statement was recorded by the police on 23.10.2024 wherein he is said to have accepted his guilt. Learned counsel for the petitioner further submits that except confessional statement, there is no material against the petitioner which connects him to this case. There is no eye-witness to the occurrence. The petitioner has been made accused in this case only on the basis of suspicion. Lastly, it has been submitted that the petitioner is in custody since 22.10.2024 having no criminal antecedents. Charge-sheet has been submitted in the case.

5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount
