JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-01-2021 Learned counsel for the petitioners informs the Court that petitioner no.3 has been arrested and as such the application on behalf of the petitioner no.3 has become infructuous and as such the application on behalf of petitioner no.3 is dismissed as infructuous.

Heard learned counsel for the petitioners and the counsel appearing on behalf of the State.

Petitioner No. 1, 2 and 4 are apprehending arrest in connection with Industrial Area P.S. Case No. 103 of 2020 for the offence under sections 147, 148, 149, 341, 323, 384, 307, 379, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioners have no criminal antecedent.

Patna High Court CR. MISC. No.31145 of 2020(2) dt.19-01-2021 2/2 It is alleged that the petitioners have demanded rupees one lakh as Rangdari and forcibly took Rs. 55000/- and also snatched golden chain from Bechan Yadav.

Learned counsel submits that they have been falsely implicated in this case. They have committed no offence. Considering the fact that the petitioners have no criminal antecedent, the Court is inclined to grant anticipatory bail to the petitioners, let the petitioner no. 1, 2 and 4 in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction learned Chief Judicial Magistrate, Buxar, in connection with Industrial Area P.S. Case No. 103 of 2020 subject to the condition the petitioners shall deposit Rs. 10000/- cash each in the court below and the amount of Rs. 10000/- cash each deposited by the petitioners shall abide by final outcome of the pending criminal case with further condition as laid down under section 438(2) of the Cr.P.C.
