The petitioner seeks bail in Ballia P.S. Case No. 91 of 2021, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, while informant, his brother and cousin brothers were cultivating the land in the meantime, petitioner along with other FIR named accused persons having armed with pistol came, abused and demanded Rs. 1 lakh as rangdari. On refusal, this petitioner along with coaccused Shivam Kumar, Aman Kumar made indiscriminate firing and due to fear informant gave Rs. 17,000/- to this petitioner. Other co-accused also fired causing injury to informant and his cousin.

It is submitted on behalf of the petitioner that there is

Patna High Court CR. MISC. No.41976 of 2021(2) dt.26-10-2021 2/2 no allegation of causing firearm injury to anyone against this petitioner. Allegation of causing firearm injury is against other co-accused persons. There is general and omnibus allegation. Both parties are agnates. Admittedly, there is land dispute between the parties and one title suit no. 81 of 2019 is pending between the parties. Petitioner is in custody since 03.04.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 91 of 2021.
