The petitioner Deven Rajbanshi seeks bail in Teragach P.S. Case No. 37 of 2013, registered for the offences punishable under Sections 341, 324, 326, 332, 333, 353, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. Binod Kumar Singh, the S.H.O. of Fatehpur police station alleged that while he along with other police officials was going for raid, Podo Rajbanshi assaulted Panna Lal Manjhi with sharp edge weapon on his shoulder. The petitioner is alleged to have fired but nobody was injured in the firing. Learned counsel for the petitioner submits that the petitioner is in jail since 02.05.2014.
Considering the facts aforesaid and the fact that the
Patna High Court Cr.Misc. No.31124 of 2014 (3) dt.12-01-2015 petitioner has remained in jail for more than eight months, he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Kishanganj in connection with Teragach P.S. Case No. 37 of 2013, subject to the condition that one of the bailors shall be a close relative of the petitioner and should have substantial property in his name in India.
