The petitioner seeks bail in Shikarpur P.S. Case No. 74/2019, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that on getting secret information police party reached at the place of occurrence and intercepted a white colour Maruti Car. The police arrested two persons, namely, Suresh Chaudhary and Srikishun @ Doma Paswan who were found sitting in the aforesaid car. On search, the police recovered total 18 litres of foreign liquor from the aforesaid vehicle. The apprehended person disclosed the name
Patna High Court CR. MISC. No.29806 of 2019(2) dt.08-05-2019 2/2 of this petitioner. It is further alleged that on the disclosure of apprehended persons, 2889 litres of illicit liquor has been recovered from a newly constructed room of High School. Learned counsel for the petitioner has submitted that name of this petitioner has transpired in this case on the basis of confession of apprehended accused persons, namely, Suresh Chaudhary and Srikishun @ Doma Paswan. Nothing has been recovered from conscious possession of this petitioner. Petitioner is in custody since 10.03.2019 having clean antecedent.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, West Champaran at Bettiah, in connection with Shikarpur P.S. Case No. 74/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
