The petitioner seeks bail in Digha P.S. Case No. 161 of 2021, registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other FIR named accused persons entered into the house of informant and thereafter, abused and assaulted her with lathi, bamboo and stick. It is further alleged that when son and husband of informant came to rescue her, they were also assaulted by the accused persons. Petitioner is alleged to have assaulted the informant with bamboo.

It is submitted on behalf of petitioner that admittedly, there is land dispute between the parties. Petitioner is alleged to have assaulted with bamboo. Specific allegation of assault is

Patna High Court CR. MISC. No.42528 of 2021(2) dt.28-10-2021 2/2 against Shankar Rai, who assaulted son of informant on his leg. It is further submitted that the informant sustained injury on her forehead and opinion, with regard to nature of injury, has been kept reserved by the doctor. Petitioner is in custody since 10.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna / concerned court in connection with Digha P.S. Case No. 161 of 2021.
