The petitioner Meghu Sharma seeks bail in Sessions Trial No. 251 of 2014, arising out of Warishnagar P.S. Case No. 50 of 2014, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

Nitesh Kumar Singh the informant made allegation that his brother Sitesh Kumar Singh @ Gopi was killed. The deceased had altercation with Meghu Sharma, the petitioner and Pramod Sah.

Learned counsel for the petitioner submits that the informant is not an eye witness of the occurrence. There appears that nobody has seen anybody killing Sitesh Kumar Singh @ Gopi and on mere suspicion name of the petitioner has been mentioned

Patna High Court Cr.Misc. No.31121 of 2014 (3) dt.12-01-2015 in the FIR.

Considering the facts aforesaid and the fact that the petitioner is in jail since 14.03.2014, he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ad hoc Additional Sessions Judge, Ist, Samastipur, in connection with Sessions Trial No. 251 of 2014, arising out of Warishnagar P.S. Case No. 50 of 2014.
